Cochlear Implants
Advanced Bionics sold defective cochlear implants that have caused injuries to cochlear implant recipients across the country. The defect in the cochlear implants causes, among other things, a deterioration in hearing performance resulting in surgery to remove the defective cochlear implants. Advanced Bionics recalled the initial versions of its HiRes Ultra and HiResUltra 3D cochlear implant devices due to the defect.
In addition to the problems encountered when using the defective device, cochlear implant recipients may be unnecessarily subjected to risks associated with a revision surgery to remove the defective device and replace it. Those risks include facial nerve weakness or injury which may cause a temporary or permanent weakening or full paralysis on the same side of the face as the surgery, bleeding, infection, ringing in the ear, dizziness or vertigo, taste disturbances, numbness around the ear, meningitis, loss of hearing, cerebrospinal fluid leakage, perilymph fluid leak, failure of the replacement cochlear implant and all other risks associated with general anesthesia.
Furthermore, a decrease in hearing often involves developmental setbacks, problems at school and in social settings and increased anxiety. Advanced Bionics should be held accountable for these losses and should not be allowed to place profits over customer safety.
However, medical device companies often attempt to avoid full accountability for the harm they cause. Mr. Morgan understands that Advanced Bionics may currently be making settlement offers to affected individuals and families that are, in Mr. Morgan’s opinion, woefully inadequate to fully and fairly compensate them, and these settlement offers may include full releases of claims that will prevent affected individuals from ever receiving full and fair compensation. Please speak with an attorney that is experienced with cochlear implant litigation before entering into any such settlement agreement, in order to fully understand your rights. Even if you have already entered into such an agreement, especially concerning a child, please speak with a qualified attorney such as Mr. Morgan in order to determine what legal rights you may have.
We are investigating claims of deterioration in hearing performance, sensations of being shocked, intermittent functioning, sudden loud noises or popping sounds, and claims involving young children who refuse to use their cochlear implant or who cry when the cochlear implant is activated.
